These Terms of Use (“Terms”) govern your access to and use of the Smart Credit Hub website located at https://smartcredithub.com (the “Site”) and all services, content, features, and functionality offered through the Site (collectively, the “Services”).

– You have not accessed your account for 24 months
– Your account poses a security risk or regulatory concern

6.4 Effect of Termination

⚖️ 7. DISPUTE RESOLUTION AND ARBITRATION

7.1 Informal Dispute Resolution

Before pursuing formal legal action, you and Smart Credit Hub agree to attempt to resolve any dispute through informal negotiation:

Either party must send the other a written notice of the dispute
– The notice must include a detailed description of the dispute and a proposed resolution
– Both parties agree to negotiate in good faith for 30 days
– A representative with authority to settle the dispute should participate in negotiations

7.2 Binding Arbitration

If the dispute cannot be resolved through informal negotiation, you and Smart Credit Hub agree that any dispute shall be resolved by binding arbitration, rather than in court, except where prohibited by law:

7.4 Small Claims Exception

Notwithstanding the above, disputes involving small claims may be brought in small claims court instead of arbitration, if permitted by applicable law.

7.5 No Class Action

You and Smart Credit Hub agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class action or class representative action. You waive your right to participate in any class action lawsuit or settlement.

7.6 Equitable Relief

Notwithstanding the above, either party may seek equitable relief (injunctions, specific performance) in court if necessary to prevent irreparable harm.

🌍 7. GOVERNING LAW AND JURISDICTION

8.1 Governing Law

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law principles. Smart Credit Hub is based in Brazil and operates primarily under Brazilian law.

8.2 Jurisdiction and Venue

To the extent permitted by law:

You and Smart Credit Hub irrevocably consent to the exclusive jurisdiction of the courts located in Brazil
– You irrevocably waive any objection to venue in such courts
– Any legal action or proceeding relating to these Terms must be brought exclusively in courts located in Brazil

8.3 Application of Brazilian Law

These Terms are subject to:

Lei Geral de Proteção de Dados (LGPD – Brazilian General Data Protection Law)
– Código de Defesa do Consumidor (Consumer Protection Code)
– Other applicable Brazilian federal, state, and local laws

8.4 International Use
